March, 2007 - Brick BrownDewayne Lonas and Pam Sellers, along with legal assistant Vicki Douglas recently received a defense verdict on behalf of CNH America LLC and Old Dominion Tractor and Equipment Company, Inc. in a $10 million products liability action.  The lawsuit involved a former Virginia Power employee who claimed that he was pitched out of a loader backhoe by an improperly designed door and an improperly manufactured component part which resulted in a neck injury which left him totally disabled.  The complaint also asserted various warranty claims, all of which were dismissed on summary judgment prior to trial.  Following a four day trial, the jury deliberated briefly and then returned a verdict in favor of defendants on all remaining claims.

Mr. Kiker's practice is devoted to helping clients prepare for and respond to the demands of litigation.  He provides national and regional representation of manufacturers and other businesses, coordinating the efforts of in-house counsel, business personnel, and local counsel to initiate and respond to discovery, with a particular emphasis on the protection of corporate assets, including trade secrets and other intellectual properties, through cohesive discovery and motion practice strategy.  He also counsels clients on risk management, records retention, and litigation preparedness, including the retention, destruction, and discovery of electronically stored information.  Mr. Kiker also counsels clients on product standards and regulations, contract and license drafting and interpretation, and technological solutions to legal problems, including the development and implementation of extranet solutions, and electronic records management and production.

He is admitted to practice in Virginia, Arizona and Florida and is a member of the Defense Research Institute, Product Liability Advisory Council, Sedona Conference Working Group on Electronic Document Retention and Production, Henrico County Bar Association, and the Greater Richmond Chamber of Commerce - Henrico County Business Council.  He is also a member of the Virginia State Bar Third District Committee on Lawyer Discipline. 

Mr. Kiker received his B.S. in Business Administration from the University of Phoenix (1989), and his J.D. magna cum laude from the University of Michigan Law School (1994) after spending eleven years in the computer and semiconductor industries.
