March, 2007 - Brick BrownDewayne Lonas and Pam Sellers, along with legal assistant Vicki Douglas recently received a defense verdict on behalf of CNH America LLC and Old Dominion Tractor and Equipment Company, Inc. in a $10 million products liability action.  The lawsuit involved a former Virginia Power employee who claimed that he was pitched out of a loader backhoe by an improperly designed door and an improperly manufactured component part which resulted in a neck injury which left him totally disabled.  The complaint also asserted various warranty claims, all of which were dismissed on summary judgment prior to trial.  Following a four day trial, the jury deliberated briefly and then returned a verdict in favor of defendants on all remaining claims.

Mr. Lonas is a trial lawyer and counselor for business owners and professionals.  His litigation experience has been deep and diverse, ranging from disputes involving breach of contract, breach of warranty, product liability, construction defects, premises liability, and professional negligence.   He has tried numerous cases to verdict and successfully guided many cases to pretrial summary disposition.  As a business counselor, Mr. Lonas has helped form new corporations and limited liability companies; negotiated leases, construction agreements, franchise agreements, service contracts, and a variety of other commercial instruments; and advised on contract and statutory compliance matters.  His clients include startup businesses and Fortune 500 companies.

Mr. Lonas frequently practices in the state and federal trial courts in Virginia.  However, he has worked extensively on cases filed in the state and federal trial courts of West Virginia, Ohio, Texas, Pennsylvania, and California.  He also has appellate experience in the Supreme Court of Virginia and the United States Court of Appeals for the Fourth Circuit.
